Terms of Use
Last updated: 23 July 2026These Terms of Use (“Terms”) apply to the GrocerCheck mobile app, website and related services (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
In plain language
- GrocerCheck is a planning tool. It compares publicly available grocery information but does not sell groceries or guarantee retailer prices or stock.
- Check before buying. Prices, specials, conditions and availability can change after our last update.
- The optimiser uses assumptions. A lower displayed basket total may not account for travel costs, your time or personal preferences.
- Use the Service fairly. Personal shopping use is welcome; scraping, interference and unauthorised commercial use are not.
1. Who may use GrocerCheck
You must be at least 13 years old to create an account. If you use the Service on behalf of an organisation, you confirm that you have authority to agree to these Terms for that organisation. The Service is intended primarily for people comparing grocery prices in New Zealand.
2. Your account
You must provide accurate information when creating an account and keep your sign-in details secure. You are responsible for activity performed through your account unless caused by something we are responsible for. Tell us promptly at kiaora@paulnz.tech if you suspect unauthorised access.
3. What the Service does
GrocerCheck collects and organises publicly available product, price, promotion and branch information from New Zealand supermarkets. It lets you search and compare products, maintain shopping lists, view price history, create alerts and estimate different ways to split a basket between stores.
GrocerCheck is an independent information and planning service. We are not affiliated with, endorsed by, sponsored by, or acting as an agent for PAK'nSAVE, New World, Woolworths or their parent companies. Retailer and product names, logos and trade marks belong to their respective owners and are used only to identify the relevant retailer or product.
4. GrocerCheck does not sell groceries
The Service does not form part of a purchase from a supermarket. GrocerCheck does not process your grocery payment, reserve stock, place an order, control a retailer's website or enter into a sale contract for grocery products. Any purchase is made directly between you and the relevant retailer and is subject to that retailer's prices, availability, terms and policies.
5. Prices, promotions and product information
We work to keep information useful and current, but retailer information can change frequently and without notice. Unless expressly stated otherwise:
- displayed information is indicative and may not match the shelf, checkout or retailer website at the time you buy;
- prices and promotions may vary by branch, fulfilment method, region, date, time or customer eligibility;
- specials may require a loyalty account, coupon, minimum quantity or other retailer condition;
- product names, images, pack sizes, unit-price calculations, nutritional details and availability may be incomplete or inaccurate;
- delivery fees, service fees, deposits, substitutions and out-of-stock products may not be included.
Always confirm the current product, price, promotion terms and availability with the retailer before purchasing. If you spot incorrect information, please report it.
6. Basket comparisons and estimated savings
Basket totals and savings are estimates based on the items, quantities, selected branches and price information available when the comparison is calculated. The optimiser may compare a single-store shop with a split between stores, but it may not account for:
- travel distance, fuel, parking, public transport or the value of your time;
- store opening hours, accessibility, queues or changing stock levels;
- acceptable substitutions, brand preferences or product quality differences;
- membership pricing, personalised offers or retailer-imposed purchase limits;
- changes made by a retailer after our data was last refreshed.
You decide whether a suggested plan is suitable for you. A displayed saving is not a promise that you will achieve that amount.
7. Price history and alerts
Price history reflects information available to GrocerCheck and may contain gaps. Alerts are a convenience only: they may be delayed, duplicated or not delivered because of device settings, connectivity, provider outages or changed retailer information. Do not rely on an alert to purchase a time-sensitive or essential product.
8. Acceptable use
You may use the Service for lawful personal or household shopping purposes. You must not:
- scrape, crawl, harvest, copy or bulk-download Service data except where we give written permission;
- use automated means to create accounts, query the Service or bypass access limits;
- reverse engineer, decompile, probe or attempt to discover source code except where the law expressly permits it;
- interfere with security, overload infrastructure, introduce malware or attempt unauthorised access;
- resell, sublicense or commercially exploit the Service or its data without our written permission;
- impersonate another person, provide misleading information, or use the Service unlawfully or to infringe another person's rights.
9. Your lists and account content
You retain ownership of the shopping lists and other content you create. You give us permission to host, process and display that content only as needed to provide, secure and improve the Service. You are responsible for ensuring content you submit is lawful and does not contain another person's sensitive or confidential information without permission.
10. Our intellectual property
GrocerCheck and its original software, visual design, branding, content and compilation of data are owned by us or our licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for its intended purpose. No other rights are granted.
11. Third-party services and content
The Service may rely on or link to retailer websites, app stores, maps, Firebase or other third-party services. We do not control those services and are not responsible for their availability, security, content or terms. Your use of a third-party service is governed by its own terms and privacy policy.
12. Privacy
Our Privacy Policy explains how we handle personal information. By using the Service, you acknowledge that information will be handled as described there and according to the choices you make in the app and your device settings.
13. Service availability and changes
We may update, add, remove, suspend or discontinue features, retailer coverage or parts of the Service. We do not guarantee that the Service will always be available, error-free or compatible with every device. We may perform maintenance or respond to technical, security, legal or third-party changes without advance notice where necessary.
14. Disclaimers and consumer rights
The Service is provided on an “as available” basis. To the extent permitted by law, we do not give warranties that retailer information is complete, current or accurate, that a product will be in stock, that an alert will arrive, or that a basket plan will produce a particular saving.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or other law where that right or remedy cannot legally be excluded.
15. Limitation of liability
To the maximum extent permitted by law, GrocerCheck will not be liable for indirect, incidental, special or consequential loss, loss of opportunity, or loss arising from retailer price changes, unavailable stock, travel decisions, substitutions, missed alerts, third-party services or reliance on information displayed by the Service.
These limitations do not apply to liability that cannot lawfully be excluded or limited. You remain responsible for checking retailer information and deciding whether a product or shopping plan meets your needs.
16. Suspension, termination and account deletion
You may stop using the Service at any time. You can delete your account and associated personal information through the in-app Account settings or through our account deletion process.
We may restrict or suspend access where we reasonably believe an account has breached these Terms, threatens the Service or other users, creates legal risk, or is being used fraudulently. Where reasonable, we will provide notice and an opportunity to address the issue.
17. Changes to these Terms
We may update these Terms to reflect changes to the Service, law or business practices. We will publish the revised Terms with a new “last updated” date. If a change is material, we will provide additional notice through the Service or another appropriate channel. Continuing to use the Service after updated Terms take effect means you accept them.
18. New Zealand law and disputes
These Terms are governed by New Zealand law. New Zealand courts have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable consumer law. If a concern arises, please contact us first so we can try to resolve it promptly.
